Terms of Service

Agreement and accounts

These terms govern access to PITCH, a contractor CRM, business operations, accounting, and payroll-support platform provided by Plug and Play Sales & Consulting. By creating or using a workspace, you represent that you are authorized to act for the business and agree to these terms. You are responsible for accurate account information, authorized users, strong credentials, and activity performed through your workspace.

Permitted use and workspace administration

PITCH may be used for legitimate business operations. You may not use it to break the law, access another workspace, distribute malware, deceive customers, infringe rights, send communications without required consent, probe the service without written permission, or interfere with availability or security. Workspace owners and administrators are responsible for assigning appropriate roles, removing access promptly, reviewing sensitive permissions, and ensuring that users are authorized to handle customer, employee, accounting, and payroll records.

Copyright and repeat infringement

You must have the rights and permissions required for files, photos, designs, text, templates, and other material you upload or share through PITCH. We may remove or disable access to material in response to a complete copyright notice, notify the affected user, process a valid counter-notice, and restore material when legally appropriate. In appropriate circumstances, PITCH may suspend or terminate users or workspaces that repeatedly infringe copyrights. The notice requirements, counter-notice process, and copyright contact are published in the DMCA Copyright Policy.

Your data, ownership, and instructions

You retain your rights in information you submit. You authorize PITCH and its service providers to process that information to operate, secure, support, maintain, and improve the requested service. PITCH does not sell contractor customer lists or use them for unrelated advertising. You are responsible for having lawful authority to provide customer, employee, vendor, tax, banking, and project information and for honoring applicable access, correction, retention, deletion, and communication requests.

Security, availability, and recovery

PITCH uses layered safeguards described in the Trust Center, including server-enforced workspace boundaries, role-based access, encrypted secrets and protected documents, managed database encryption, secure sessions, audit records, malware-gated uploads, health checks, release preflights, and managed point-in-time database recovery. You remain responsible for endpoint security, account access, accurate permissions, and exports required by your own continuity plan. No internet service can guarantee uninterrupted operation, absolute security, or recovery of every event under every circumstance.

PITCH Books

PITCH Books provides company-scoped accounting, receipt, banking, reconciliation, job-cost, reporting, close, and professional-review workflows. The workspace is responsible for reviewing opening balances, account mappings, classifications, tax treatment, reconciliations, source documents, approvals, and reports before relying on them. PITCH is software, not an accounting firm, fiduciary, auditor, lender, or substitute for a qualified accountant.

PITCH Books Payroll

PITCH Books Payroll supports controlled payroll records, approved time and wage inputs, calculations under configured policies, pay statements, job-cost allocation, workpapers, corrections, and professional review. Payroll availability is limited to jurisdictions and features expressly enabled in the product. The employer remains responsible for worker classification, wage-and-hour compliance, tax registrations, rates, deposits, filings, notices, funding, employee authorizations, and record retention. PITCH does not act as the employer, payroll tax return preparer, electronic return originator, or government payment transmitter.

Federal, state, and local tax workpapers are not filed returns. Where PITCH provides a professional-review workflow, an independently engaged CPA or EA must make substantive tax decisions, complete and sign the return, obtain required taxpayer authorization, transmit through the professional firm's controlled system, monitor acknowledgments or rejects, and retain official filing evidence. Employers should retain employment-tax records for at least the period required by the IRS and longer when another law, agency, dispute, or legal hold requires it.

Integrations and third-party services

Connected providers have their own terms, pricing, availability, review processes, and data practices. A listing in PITCH does not mean a connector is active, endorsed, or approved by that provider. You authorize PITCH to exchange only the records and permissions presented during setup. You may disconnect a service, but the provider may retain information under its own policies.

Communication. Gmail uses basic identity and gmail.send; Microsoft uses delegated identity, offline access, User.Read, and Mail.Send. These mailbox connections do not authorize PITCH to read or search inbox content. Yahoo uses a user-created app password. Twilio and preserved existing messaging connections remain subject to consent, sender registration, carrier, and provider requirements.

Accounting, payments, and AI. QuickBooks Online and an activated Xero connection are controlled by the workspace owner or administrator. Square and Stripe process configured billing or customer payments. OpenAI processes content only when a user invokes an enabled PITCH Copilot workflow. You remain responsible for reviewing mappings, tax treatment, duplicates, payment status, and generated output.

Project and measurement providers. CompanyCam, EagleView, RoofScope, HOVER, JobNimbus, AccuLynx, and GAF QuickMeasure require separate provider access, licensing, or approval. PITCH does not exchange data with one of these providers until the related production connector is activated and an authorized workspace user completes setup.

Apple and mobile distribution. Mobile clients remain subject to applicable app-store terms, device permissions, and review requirements. Denying an optional device permission may limit the related feature but does not authorize unrelated collection. Users can review privacy and deletion information from the service and mobile client.

Text messages and electronic communications

When a recipient opts in to project text updates, message frequency varies with project activity. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to texts is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. Contractors must identify themselves, honor opt-outs, maintain consent records, and comply with messaging, email, marketing, and carrier requirements.

Construction, measurement, financial, and AI tools

Designs, imagery, measurements, takeoffs, material lists, calculations, AI-generated drafts, financial statements, payroll workpapers, and financing illustrations support professional judgment; they are not a substitute for field verification, code review, engineering, manufacturer instructions, lender disclosures, accounting or tax review, employment counsel, or legally required documentation. You remain responsible for reviewing output before using, filing, paying from, or sharing it.

Billing, cancellation, refunds, and data preservation

Subscription fees are due according to the selected plan and billing provider. The free trial requires no card and does not automatically convert to a paid subscription. Paid plans renew monthly until canceled. Cancellation ordinarily stops future renewals and does not retroactively refund or prorate a completed billing period, subject to the Refund & Cancellation Policy and rights that cannot legally be limited.

If an account remains unpaid for more than 30 days after it becomes past due, PITCH may place the workspace in a payment-restricted, read-only state. The workspace and available records are preserved—not deleted—for restoring service when the account is paid current. During payment restriction, users may view available records but may not add, edit, send, sign, approve, run payroll, or otherwise change workspace data. Owners and administrators may access billing to restore service. This does not limit suspension for security, abuse, or legal reasons.

Suspension, termination, export, and deletion

Access may be suspended to protect users, investigate abuse, comply with law, or address nonpayment. You may stop using PITCH and a verified workspace owner may request access, export, correction, or deletion through the Data Access and Deletion page. Deletion remains subject to tax, payroll, transaction, dispute, security, professional, backup, and legal-hold retention obligations.

Disclaimers and limitation of liability

PITCH is provided on an as-available basis to the extent permitted by law. We work to maintain a reliable and secure service but do not warrant uninterrupted operation, error-free third-party integrations, or that professional output will be correct without required review. To the maximum extent permitted by law, neither party is liable for indirect, special, incidental, exemplary, or consequential damages. Any aggregate direct liability of PITCH is limited to the amount paid for the service during the three months before the event giving rise to the claim. Rights that cannot legally be limited remain unaffected.

Changes and contact

We may update these terms as the service, providers, or legal requirements change. Material revisions will be identified by a new effective date and, when appropriate, an in-product notice. Questions can be sent to support@plugandplayco.com.
